South Carolina law prohibits operating any motorized water device or watercraft under sail while under the influence of alcohol or drugs to the extent that the person's faculties are materially and appreciably impaired.
The Elements of a BUI Charge
To secure a BUI conviction, the State must prove beyond a reasonable doubt that:
- Operation: The defendant was operating or in actual physical control of a motorized water device or watercraft under sail.
- Impairment: The defendant was under the influence of alcohol, drugs, or a combination of both.
The impairment element is typically proven in one of two ways:
- Per Se Violation: The operator's Blood Alcohol Concentration (BAC) was 0.08 or higher.
- Material Impairment: Regardless of the BAC result, the operator's faculties were materially and appreciably impaired by alcohol or drugs.
A crucial difference from DUI is that unlike a car, a boat can legally contain open containers of alcohol. However, law enforcement will use the presence of alcohol and any deviation from safe boating standards (e.g., erratic operation, failing to maintain a proper lookout) as evidence of impairment.

Boating Under the Influence (BUI) penalties in South Carolina are serious and increase sharply with each subsequent offense within a ten-year period. This is far more than a simple boating citation — it carries real criminal consequences.
- First Offense: Fine of $200–$400, 48 hours to 30 days in jail (or community service), and 6-month loss of boating privileges.
- Second Offense: Fine of $2,000–$5,000, 48 hours to 1 year in jail (or community service), and 1-year loss of boating privileges.
- Third Offense: Fine of $3,500–$6,000, 60 days to 3 years in jail, and 2-year loss of boating privileges.
