Parole Violation Attorney in Charleston

Charleston Parole Violation Lawyers Ready to Defend Your Case

An alleged parole violation moves fast. Once the South Carolina Department of Probation, Parole and Pardon Services investigates and finds cause, you can be arrested and held while a revocation hearing is scheduled before the Board of Probation, Parole and Pardon Services. At Thurmond Kirchner & Timbes, P.A., our criminal defense attorneys represent clients facing these allegations throughout Charleston, SC, and the surrounding communities.

Founded in 2005 by Paul Thurmond, Jesse Kirchner, and Michael Timbes, we built this practice on the principle that every client deserves direct communication and a strategy shaped by the specific facts of their situation. That applies as much to parole violation matters as to any other criminal defense case.

If you or a family member has been accused of a parole violation in the Charleston area, don’t wait for the hearing to approach. Call our parole violation lawyers today for a free consultation at (843) 790-0083.

Why Clients Facing Parole Violations Choose Thurmond Kirchner & Timbes, P.A.

Parole revocation hearings are high-stakes proceedings, and the outcome often hinges on how well the facts are developed and presented. We keep clients informed at every stage, explaining what the Board can consider, what evidence is in play, and what options exist. There are no surprises on the day of the hearing.

Our team of 14 attorneys and a large support staff gives us the resources to investigate the circumstances behind an alleged violation thoroughly. We don’t apply a one-size-fits-all approach. The defense we build for a missed check-in looks different from the one we build for a new criminal charge, because the facts and the stakes are different.

How a Parole Violation Case Proceeds in South Carolina

The process begins with supervision. The South Carolina Department of Probation, Parole and Pardon Services monitors individuals on parole and investigates alleged violations when a concern is reported. If the investigation produces enough cause, the parolee can be arrested and held pending a preliminary hearing to determine whether probable cause exists to proceed. If that threshold is met, the case moves to a final revocation hearing before the Board of Probation, Parole and Pardon Services, which decides the outcome.

Getting a parole violation attorney involved early matters. The preliminary hearing is the first opportunity to contest the evidence before the Board convenes.

Technical Violations vs. Substantive Violations

South Carolina parole violations fall into two broad categories, and the distinction shapes how the Board approaches the case.

  • Technical violations involve a failure to comply with a parole condition, such as missing a scheduled check-in with a supervision officer, failing a drug test, or violating a travel restriction. These don’t necessarily involve new criminal conduct.
  • Substantive violations involve being charged with a new criminal offense while on parole. These tend to carry more weight in the Board’s deliberations because they suggest new criminal activity rather than a compliance lapse.

Because the Board can consider the nature of the violation when deciding on sanctions, identifying and presenting context around the alleged conduct is a central part of the defense.

Our Approach to Parole Violation Defense in Charleston, SC

When we take on a parole violation case, we start by reviewing the evidence behind the alleged violation: the supervision officer’s reports, the circumstances of any arrest, and any documentation the Department of Probation, Parole and Pardon Services has compiled. From there, we work to identify mitigating circumstances to present at the revocation hearing.

Factors the Board may weigh include compliance history prior to the alleged violation, current employment or community ties, and the specific circumstances surrounding the incident. We present these facts in a way that gives the Board a complete picture rather than a one-sided account.
